Killer sentenced to probation is now headed to prison

A man convicted of manslaughter and sentenced to probation in 2017 is now headed to prison.

On Feb. 14, 2016, Xavier Torres and another man, Dimalier Rosado, were kicked out of a bar in Port Aransas.

According to the arrest affidavit, the men returned and were confronted at the entrance by the bartender and a man named Clyde Leonard.

The men were told to leave, but police said Rosado threw a punch at Leonard. Leonard swung back, knocking Rosado to his knees.

That’s when Port Aransas Police Department officers said Torres stabbed Leonard in the chest, side, and wrist.

Leonard died at the hospital.

Both Rosado and Torres were charged with murder.

In April 2017, Torres was convicted of the lesser charge of manslaughter and sentenced to 10 years of probation.

As part of his probation, Torres was required to turn himself in every Feb. 14, the anniversary of the incident, for two weeks for the next 10 years.

The Nueces County District Attorney’s Office announced that on Aug. 28, Judge Ina Klein revoked Torres’ probation and sentenced him to serve 10 years in a Texas Department of Criminal Justice facility.

The Motion to Revoke Probation was filed after Torres was arrested for Driving While Intoxicated in Killeen.

Court records show Rosado was acquitted of murder in 2017.
