He was brought back and processed into the Nueces County Jail around 5:00 am Tuesday morning according to jail officials.  Ortiz had a warrant out for his arrest from Robstown P.D. in connection with the death of the 18-month-old girl back on Dec. 22, 2017.  Ortiz was charged with capital murder of a person under ten years of age.

The Nueces County Medical Examiner’s preliminary report ruled Arabella’s death a homicide following reports that her injuries were caused by blunt force trauma, as if Arabella was slammed against something three or four times, and did not appear to be continuous abuse.

Court documents say the DNA evidence from blood and skin collected underneath Arabela’s fingernails belong to the mother’s boyfriend.   Murder charges against Chasity Herrera were dropped.

Ortiz’s bond was set at $1 million.
