Another mistrial is declared for murder suspect David Davila.

He’s accused of fatally shooting 13-year-old Alex Torres at the Treyway Apartments in 2015.

Prosecutors say Davila intended to shoot his ex-girlfriend, but shot the teenager by mistake.
In September, Davila’s first trial ended in a mistrial as well.
We’re told the judge declared a mistrial because prosecution witness Christina Trevino gave testimony that was not supposed to be introduced in the trial.

Meanwhile, the grandparents of Alex Torres are still waiting for closure.

“I know, I know that God will prevail for us it’s a test that we’re going through and deep in my heard I know he will prevail for us,” said Alex’s grandfather, Donaldo Gutierrez”

The family tells us the case is expected to be tried for the third time in April.
As for Christina Trevino, she has yet to be sentenced.
She faces up to 20-years in prison.
