SAN ANTONIO (AP) – A 31-year-old man who witnessed a car theft at a San Antonio gas station was shot and killed while pursuing the suspect.

A San Antonio Police Department statement Monday says 23-year-old Jacob Gabriel has been arrested and charged with vehicle theft, firearm theft, and murder. He was booked into the Bexar County Jail with bonds set totaling $170,000.

The police statement says Gabriel jumped into a car left idling at the gas station and drove off. Witnesses pursued the car in their own vehicles until Gabriel stopped, jumped from the vehicle on foot and was confronted. At that point, police said, Gabriel shot one man fatally with a gun he had found in the stolen vehicle.

Gabriel’s attorney Leland McRae said: “Self-defense is a two-way street.”
