Troubleshooters: Lexus Damage

On today's Troubleshooters a woman has a complaint about a contractor who damaged her car as he was leaving her house.  So she wants him to pay to get it fixed.

On September 28th, Lee Roy Elizondo backed his truck into Micaela Pena's 2011 Lexus as he was leaving her house.  To his credit, he stopped and let her know what happened.

According to Pena, Elizondo told her "I don't want to file an insurance claim.  I know somebody who has a body shop, or who does body shop work.  I'll get you in contact with him."

Pena showed us pictures of the extent of the damage to her car.  "The headlight was broken and the radiator had to be realigned," she recalled.  She says that's what a body shop told her, but not "Touch 'n Go," the shop Elizondo recommended.

"I don't want my Lexus to get repaired in somebody's garage," she lamented.  Elizondo had just finished laying carpet at Pena's home.  Less than 2 weeks later, Pena's car still hasn't been fixed, and that's why she says she's called us.

Pena says she has insurance, but is reluctant to file a claim and have her premium go up.  "I want Lee Roy to fix my vehicle.  I want him to pay for the damages, and I wanna decide where my vehicle's gonna get repaired."  

The Troubleshooters contacted Lee Roy Elizondo this afternoon.  We asked "would you agree it's your responsibility to make sure that her car gets fixed?  "Oh my God," he responded.  "I'll get a hold of Joe and get it taken care of." 

"How would you react if this was your car Mr. Elizondo?  I know.  It's happened to me before on several occasions.  I mean it's a little different now, so I understand." 

Mr Elizondo promises he'll get this taken care of right away.  As always, we'll let you know if or when this gets resolved.
