Florida man claims girlfriend choked to death during oral sex

FLORIDA -

The opening of a murder trial in Fort Lauderdale, Florida got off to an unusual start on Monday. 

An attorney for 65-year-old Richard Patterson is pleading to show his client's penis to support his defense. 

Patterson is charged with second degree murder in the choking death of his 60-year-old girlfriend, Francisca Marquinez, back in 2015. 

Patterson has admitted to choking his girlfriend, but claims it accidentally happened during oral sex. 

His attorney claims he's innocent and says if the jury see's his client's penis, he can better explain his defense in the case. 

No details have been released on when a judge will rule on the request of the defendant. 

Prosecutors are arguing that Patterson called his lawyer one to three days after she died instead of calling for help.
