CORPUS CHRISTI - Today's hearing involving the City of Corpus Christi and the New York-based company, Community Showcase Banners, didn't take place.
On June 14, 2012, David McCarthy approached former Mayor Joe Adame at a mayoral conference. City Attorney Carlos Valdez said McCarthy claimed the City had been awarded a "Community Showcase Banner Prize." Valdez said that "prize" included the sale of banners for the light poles that line the streets. At the conference, Mayor Adame signed a contract with McCarthy but Valdez says the contract was never valid because the Mayor doesn't have that kind of authorization.
Judge Robert Galvan signed an order prohibiting Community Showcase Banners from selling the banners and using the City of Corpus Christi on the banners. Last month the City filed a lawsuit against McCarthy after, the City claims, he ignored the order to stop selling street banners and continued to use the City as a selling point to customers.
Valdez said the records show Community Showcase Banners sold 250 banners locally at $600 a piece. Valdez estimated customers paid a total of $150,000 for banners that were never installed.
McCarthy was due in court today but filed a notice of removal in the case requesting that it be transfered to a federal court. Customers said they were expecting to get their money back from McCarthy today but will have to wait, now, for the federal court hearing.
Initial calls to reach McCarthy for comment went unanswered.
