Guilty Verdict Doesn't Ease Pain for Victim's Mother

CORPUS CHRISTI -- It took a jury barely an hour to find Michael Aguirre guilty of intoxication manslaughter and DWI with a child.

Police say Aguirre caused an accident that killed David Garner, 45, back in June of 2011. Aguirre had been drinking and witnesses told police Aguirre got out of his car and punched the victim's body after the crash.

Police say Aguirre's daughter and girlfriend were also in the car at the time. Both families were in the courtroom as the the guilty verdict was read.

Following the verdict was testimony for the punishment phase. The victim's mother, Mildred Garner, took the stand.

"I'm experiencing indescribable grief, which does not seem to decrease with the passage of time but only seems to perhaps intensify," Mildred said.

After the verdict was read some of Aguirre's family members were in in tears while other's were in shock. Meanwhile, Mildred says the verdict doesn't quite ease the pain of losing David.

"Everything in my house reminds me of him, David repaired this television set, David moved this furniture, David edged this part of the lawn, everything in my home reminds me of David and how much I miss him," Mildred said.

She says david was full of life and had his taken away far too soon and that she can't imagine the life he could've led.

"There are the negative affects of grief, of missing him and of longing for what they could have done and did not get to do," Mildred said.

Aguirre's attorney's asked Mildred if she could ever forgive him for the causing the death of her son, her response:

"I have contemplated on that and meditated upon that almost daily and my prayer if I may state it, is justice tempered with mercy," Mildred said.

A simple prayer is what Mildred says she lives by and constantly seeks support from her church.

The jury will deliberate the punishment for Aguirre who could face up to 20 years in prison.
