Attorney Sued By Former Client

CORPUS CHRISTI -- Things haven't been easy for Floyd Zahn. In November 2010, his son Timothy died in an industrial accident in Bishop. Just 7 days later, Zahn's second son, Thomas, passed away.

Just two days later, Zahn claims attorney Daniel Horne, offered to represent Zahn in a case over the death of his fist son.

It's the subject of a civil lawsuit filed today. We spoke to Zahn's new attorney, Marynell Maloney, by phone.

"Of course he's grieving and that's one of the worst parts about attorneys who prey on victims like this, is that they're catching people when they're at their weakest and lowest," said Maloney.

The lawsuit says Horne, who works at a firm in Corpus Christi, paid a Kingsville funeral director $500 to set up a meeting between himself and Zahn.

According to the lawsuit, Horne pressured Zahn to hire him for a case against the company where his son Timothy died in the industrial accident.

The lawsuit states Zahn felt he had no choice but to agree because he was told by Horne if he didn't he could lose his ability to sign on and participate.

The lawsuit also reads, "Over the course of the next ten months, Mr. Zahn received little communication from Mr. Horne about his case."

Zahn's attorney says he got a small settlement from his son's death, mainly because he wasn't included in the process.

She also says Horne wound up making around $120,000 for his part in the lawsuit and says Zahn should get that money back.

Maloney said, "It gives attorneys justifiably a horrible name if they're going to be soliciting clients and then badly representing them."

We went to attorney Daniel Horne's office today but he says he didn't know anything about the lawsuit. We asked he give us a call when he knows more. So far, we haven't heard back.
